Virginia Brachial Plexus Lawyer
This injury occurs along the brachial plexus, which is nerve bundle affiliated to the CNS or the Central Nervous System. It is housed in the spinal column and due to the location and sensitivity; injuries to this plexus may be sustained during birth. The main way this particular injury occurs is by stretching the nerves in the spinal column. If they are overstretched or if they tear then the injury occurs. This causes permanent damage to the nervous system and in some cases permanent paralysis. However, it may also occur later in life because of one injury or another during birth it is more often than not because of trauma. Virginia law is able to defend the injured party appropriately and accurately and ensure the compensation fits the injury in one way or another.
Brachial plexus cannot be reversed once it occurs whether it creates a tear on the nerves or causes full-blown paralysis. In the case of the newborn, this injury is mainly caused by negligence on the part of the attending obstetrician though it may also occur during a difficult childbirth. When pressure builds around the damaged nerves then the injury is compounded and if the attending physician is unable to catch it on time then this only makes the situation worse. Virginia law can then step in for the aggrieved party and file a suit on their behalf. Even though the damage has already been done, the client can hold some one accountable and get the necessary reprieve for the injury that has occurred during the birth. This is regardless of whether it was a natural birth or a cesarean section birth.
Virginia law is able to ensure that an adequate settlement is achieved in or out of court. Justice is then served for the mother of the injured child and the mother. This could be in monetary terms or medical compensation where the patient gets any therapy needed for a stipulated amount of time with relevance to their injury. Though the statistics state that approximately 9 out of 10 infants that suffer from this condition cannot recover without assistance. This is where the physical therapy comes in to keep the infants limbs moving and supple enough to regenerate the damaged muscles. Though in some cases the cause of the injury cannot be determined, the aggrieved party can get the necessary damages that will make their lives easier in the long run.
